Recent studies have found that the death penalty is not a deterrent to homicide. I know we can argue the merits of that argument but in the mean time, many states still sentence murderers to death. I point this out to highlight the dichotomy between how we punish individuals compared to big corporations. The SEC believes having fraudulent Wall Street firms promise not to violate a law that they already promised not to break, without admitting guilt, to be a deterrent.     “Our goal is always to maximize the return to investors.” Ms. Shapiro is being very blunt. Here’s my interpretation of that statement.

    “It is what it is. This is how the system works and in the end, some investors will get their money back.”
